  • Defense verdict in favor of truck driver who hit and dragged pedestrian at truck stop, crushing his foot.

Trucking Transportation Law

Despite the invaluable role trucking plays in our country's commerce, when an accident involving a tractor-trailer occurs, the company and driver are lawsuit targets. Newspapers almost vilify trucking companies. Attorneys rush to file lawsuits, knowing that many jurors fear trucks on the road and may be quick to blame them, regardless of the facts. One attorney's website dramatized unfortunate, unintended accidents by equating the number of traffic fatalities involving tractor-trailers to "ten Boeing 747 jumbo jets crashing each year killing everyone aboard."

This wholesale attack on the trucking industry and its drivers is unjustified. We at Schneider & Onofry are proud to represent trucking companies, their drivers, and insurers in truck-related accidents. Because trucking companies are targets, every accident must be viewed as a potential lawsuit. As experienced trial lawyers, we approach every aspect of the defense anticipating the matter could go to trial.

We will respond immediately to a truck accident and assist with scene investigation, driver and witness interviews, preservation of roadway evidence, documents and ECM information, and even make sure that the driver receives the required drug and alcohol testing. Schneider & Onofry has an established protocol when called in response to a truck accident. This includes securing appropriate expert witnesses on an expedited basis who can address the issues that typically arise in these cases, including accident reconstruction, mechanical inspections, and seatbelt issues.

We are also ready to assist trucking companies and their drivers with related issues such as:

  • Traffic tickets and DOT citations and violations
  • Hours of service requirements
  • Out of service orders
  • Safety ratings
  • Drug and alcohol test requirements
  • Driver qualification requirements
  • DOT equipment violations
  • General consultation regarding DOT regulatory requirements

Arizona has two major interstates (I-10 and I-40). Both are significant arteries for commercial transportation. Covering 392.33 miles across Arizona, Interstate I-10 is the southernmost east-west coast to coast interstate in the United States, running from California's Highway 1 at the Pacific Ocean to Jacksonville, Florida. Interstate I-17 runs north-south for 145.76 miles through Arizona. It intersects I-10 in Phoenix and I-40 in Flagstaff, providing access to all parts of the state.

Together, Arizona's interstate highways cross 11 counties. Our contacts with independent adjusters and experts allow us to respond immediately to any accident scene anywhere in the state.

We have also appeared in every county throughout the state. Arizona is not subject to variations from county to county with the procedural rules, evidence, and certainly not the substantive law. As such, we are fully capable of defending any case in any county. We also remove cases to Federal Court where possible. Charles Onofry of Schneider & Onofry previously served as a law clerk for a Federal District Judge in Arizona.

Automobile Transportation Law

In 2005, there were almost 6.5 million automobile accidents in the United States. The cost of these accidents totaled close to $230 billion. While medical treatment accounted for a large part of this expense, the cost is rising due to the increasing liability burden created by lawsuits that follow many accidents.

As a liability defense firm, Schneider & Onofry, P.C., has earned a reputation for its aggressiveness in taking cases to successful jury verdicts.

The firm has experience representing large national insurers as well as small independent insurance companies and has consistent success defending against personal injury and wrong death claims.

In addition, attorneys at Schneider & Onofry, P.C., handle:

  • Product liability for defective vehicles
  • Indemnity claims for defective vehicles
